Terms of Use

Last updated: October 5, 2026

Welcome to www.habitus.pub, operated by Habitus Paper and Publishing, LLC, doing business as Habitus Paper + Publishing (“Habitus,” “we,” “us,” or “our”).

These Terms of Use (“Terms”) describe the conditions governing access to our website and use of its content and features. Please review them carefully. Where we request your acceptance of these Terms, your affirmative acceptance forms an agreement between you and Habitus. If you do not agree, please discontinue use of the website.

1. Scope and Other Policies

These Terms apply to our website, including its articles, publication information, excerpts, images, downloadable resources, and any interactive features we make available.

Purchases and patron offerings are also subject to the product descriptions and applicable sales, delivery, cancellation, and refund conditions disclosed before purchase. A separate signed agreement controls where it expressly modifies these Terms.

Our Privacy Notice explains how we handle personal information. Acceptance of these Terms does not, by itself, constitute consent to promotional communications or optional tracking.

Nothing in these Terms limits consumer protections or other rights that cannot lawfully be waived.

2. Ownership of Website Content

Website content is owned by Habitus or used with permission from its authors, copyright owners, and other licensors. Protected content may include text, book excerpts, graphics, photographs, logos, illustrations, audio, video, and downloadable materials.

Habitus’s role as publisher does not mean that it owns every copyright in the publications it offers. Individual works identify their respective copyright owners, which may include The Ovesen Company, LLC or other authors and rights holders.

Accessing the website or purchasing a publication does not transfer copyright, trademark rights, or other intellectual property rights to you.

3. Permitted Use

You may browse the website, share links to publicly accessible pages, and use materials expressly offered for download according to the permissions accompanying them.

Unless a resource states otherwise, downloadable materials are provided for personal, noncommercial use. Keep copyright notices and other ownership information intact.

For resources expressly offered as printable worksheets or journal pages, personal use includes printing copies for your own use and replacement pages for your own continued practice.

These permissions do not authorize distributing copies to clients, students, members, or other groups, or including our protected materials in a paid program. Contact hello@habitus.pub to discuss group, educational, or commercial licensing.

Nothing in these Terms restricts fair use, lawful quotation, or other uses permitted by applicable law.

4. Restrictions on Use

Except where separately authorized or permitted by law, you may not:

  • Reproduce, republish, sell, sublicense, or distribute protected website content.

  • Upload purchased files or restricted resources to shared drives, public websites, or file-sharing services.

  • Share private download links or access credentials.

  • Adapt protected materials for commercial products or programs.

  • Remove copyright notices, watermarks, or access protections.

  • Use Habitus’s name or branding to imply an endorsement, partnership, or authorization that does not exist.

For permission requests, email hello@habitus.pub and describe the material, intended use, audience, and proposed distribution.

5. Acceptable Conduct

You agree not to use the website to:

  • Commit fraud, impersonate another person, or submit materially misleading information.

  • Harass, threaten, defame, or unlawfully discriminate against others.

  • Disclose another person’s private information without authorization.

  • Infringe copyright, trademark, privacy, or other legal rights.

  • Introduce malicious software or interfere with website operation.

  • Attempt unauthorized access to accounts, systems, or restricted content.

  • Collect users’ personal information without authorization.

  • Send spam or use website features for unauthorized solicitation.

We may take reasonable steps to investigate misuse, protect the website, and enforce these Terms.

6. Accounts and Restricted Access

If account or member-access features are available, you must provide accurate information and safeguard your credentials.

Notify hello@habitus.pub promptly if you suspect unauthorized use of your account. You may not access another person’s account without permission.

To purchase products or enter into a binding agreement with Habitus, you must be at least 18 years old or the age of legal majority where you live. A parent or legal guardian may make a purchase for a minor.

7. Comments, Reviews, and Other Contributions

If we enable comments, reviews, or other public submission features, you are responsible for the material you submit and must have the rights necessary to share it.

You retain ownership of your original contributions. By intentionally submitting material for public display, you grant Habitus a nonexclusive, royalty-free license to host, display, and make technical or formatting adjustments to it for that purpose. This permission does not authorize materially changing its meaning or using a private message as a public testimonial without permission.

Public contributions may be viewed or copied by others. Do not include confidential information or information you do not want made public.

We may moderate or remove spam, unlawful material, personal information, infringement, or content unrelated to the purpose of the feature. We do not guarantee that every contribution will be reviewed before publication.

Contributions represent their authors’ views and are not necessarily endorsed by Habitus. These Terms do not prohibit honest reviews or lawful criticism of our products, services, or conduct.

8. Manuscripts, Proposals, and Publishing Inquiries

Please follow any submission guidelines posted on the website and confirm that submissions are open before sending a manuscript or proposal.

Sending material does not create a publishing, agency, employment, or confidential advisory relationship. We are not obligated to accept, publish, or respond to unsolicited submissions.

You retain your rights in the material you submit. Submission alone does not assign copyright or grant Habitus a right to publish your work. Any acquisition of publishing rights requires a separate agreement.

Do not send original physical materials that you cannot replace or sensitive information unnecessary to your inquiry.

9. Educational Information

Our website and publications offer general educational and personal development material. They do not provide individualized medical, mental health, legal, financial, or other professional advice.

Reading our content or purchasing a publication does not establish a healthcare, therapist-client, or individual coaching relationship.

Consider your circumstances when applying the material and consult an appropriately qualified professional when needed. We do not guarantee a particular personal, professional, health, or financial result.

10. Purchases and Third-Party Services

Our website is hosted by Squarespace. Sales are processed through Stripe, with Apple Pay, Klarna, and Afterpay offered where available.

Payment providers may present their own terms governing their services. Installment-payment eligibility and repayment obligations are determined by the applicable provider and the agreement presented to you.

Purchases made directly through Habitus are subject to the conditions disclosed before checkout. Purchases through independent booksellers or other third-party retailers are governed by those retailers’ transaction policies.

Nothing in this section removes obligations Habitus independently owes you.

11. Links and External Content

We may link to independent booksellers, authors, social platforms, and other websites. A link does not necessarily imply endorsement, ownership, or control.

External services have their own terms and privacy practices. We do not control their availability or content.

You may link to publicly accessible Habitus pages if the link does not falsely imply endorsement or present our website as your own. Use of our logos or reproduction of protected content requires separate permission unless otherwise permitted by law.

12. Accuracy and Website Availability

We work to keep the website useful and accurate, but information may occasionally contain errors or become outdated. We may correct errors and update content.

Corrections do not authorize us to retroactively change an accepted purchase without any agreement or remedy required by law.

Website access may be interrupted by maintenance, technical problems, or events outside our reasonable control. We may modify or discontinue website features, subject to existing contractual obligations and applicable consumer rights.

13. Disclaimers and Limits on Liability

To the extent permitted by law, general website access and free informational content are provided “as is” and “as available.” We do not guarantee uninterrupted access, error-free operation, or that general information will meet every visitor’s individual needs.

This disclaimer does not override express promises concerning purchased products or warranties and remedies that cannot legally be excluded.

To the extent permitted by law, Habitus is not responsible for indirect or consequential losses arising from use of, or inability to access, the website.

These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law does not permit us to exclude. They do not excuse our obligation to fulfill accepted orders or provide legally required refunds or other remedies.

14. Reporting Copyright Concerns

If you believe material on our website infringes your copyright, email hello@habitus.pub with the subject line “Copyright Concern.”

Please provide:

  • Your name and contact information.

  • Identification of the copyrighted work.

  • The specific website address or location of the material you believe is infringing.

  • An explanation of your ownership or authority to act for the owner.

  • A statement that you believe in good faith the use is unauthorized by the owner, its agent, or the law.

  • A statement that the information is accurate and, under penalty of perjury, that you are authorized to act for the rights holder.

  • Your physical or electronic signature.

We will review the report and take appropriate action. We may request additional information or contact the person who supplied the material. This contact procedure does not represent that Habitus has registered a designated agent under the Digital Millennium Copyright Act.

15. Restriction or Termination of Access

We may restrict access reasonably necessary to address a material violation of these Terms, a security threat, unlawful activity, or a legal requirement.

Where practical and appropriate, we will provide notice and an opportunity to address the issue. Immediate action may be necessary to protect users or systems.

Restricting website access does not automatically cancel your rights in a lawfully purchased product or eliminate any refund or other remedy owed to you.

16. Governing Law and Disputes

These Terms are governed by California law, subject to mandatory protections provided by other applicable laws.

If a dispute arises, contact hello@habitus.pub so we can try to resolve it. Contacting us is not a prerequisite to exercising your legal rights and does not alter applicable legal deadlines.

Claims may be brought in a court with jurisdiction. These Terms do not require binding arbitration or waive your right to a jury trial or access to small claims court where available.

17. Changes to These Terms

We may update these Terms as the website or our practices change. Revised Terms will be posted with an updated date.

Changes apply prospectively and do not retroactively alter completed purchases or accrued rights. Where required, we will provide additional notice and obtain your agreement before material changes apply to an ongoing service.

18. General Provisions

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.

A decision not to enforce a provision on one occasion does not waive the ability to enforce it later.

These Terms and any applicable agreements expressly accepted by you govern their respective subject matter. A separate signed agreement controls where it expressly changes these Terms.
